Appellant was charged with the unlawful possession of a narcotic drug commonly known as marijuana. He waived a jury trial and the case was heard by the court which rendered a verdict of guilty and sentenced appellant to imprisonment in the county jail for a period of ninety days. The primary thrust of appellants contention on appeal is that the trial court erred in denying his motion to suppress the evidence which formed the basis for his conviction because it was the fruit of an unlawful search made in violation of his constitutional rights.
